Construction Workplace Misclassification Act - Model Clauses Available
Recently the "Construction Workplace Misclassification Act" was passed into law and it will take effect on February 11, 2011. This law attempts to "clarify" the working relationships between business owners (i.e. home builders), employees and subcontractors. The Pennsylvania Builders Association has developed a set of "model clauses" that can be added to a business owner's standard subcontract agreement when engaging independent contractors. PA Builders Association Model Contracts
The PBA is drafting a model contract to include language that addresses the new contractor registration law. Once available the model contract will be posted on the HBA web site and can be obtained by contacting Keith Ashley.

Home Improvement Contractor Registration Forms Now Available
The Attorney General's office has published a web site where the application forms for registering your home improvement business can be found. The site address is http://www.attorneygeneral.gov/hic.aspx. Note that all home improvement contractors doing more than $5,000 worth of business in a calendar year must register by July 1, 2009.
